a) Liability for defects
In which case do you have the right to warranty?
In case of faulty performance of Evetke Wear webshop operator, you may enforce a claim for warranty against it in accordance with the rules of the Hungarian Civil Code.
What rights do you have on your warranty claim?
You may choose, at your option, to claim the following: You may request repair or replacement unless the fulfillment of any of the requirements you choose is impossible or would cause disproportionate additional costs to Evetke Wear webshop operator in relation to your other possible claims. If you did not or could not request repair or replacement, you may request a proportional discount or you may repair of the defect, or have it repaired by third party at the expense of the Evetke Wear webshop operator, or if no other solution is available terminate the contract. You may also switch from your chosen warranty right to another, but you shall bear the cost of modification, unless it was justified or due to the reason related to Evetke Wear webshop operator.
What is the deadline for enforcing your warranty claim?
You must disclose the defect immediately after discovering it, but not later than within two months of the discovery. Please note that you may not enforce your warranty rights beyond the two-year limitation period after the performance of the contract.
To whom can you claim your warranty claim?
You may enforce your warranty claim against the Evetke Wear webshop operator.
What other conditions are there for enforcing your warranty rights?
Within six months of delivery, to exercise your rights to warranty, there are no other conditions, than to disclose the fact of defect, supposed that you prove that the product was bought from Evetke Wear webshop operator. However, after six months of completion, you are already required to prove that the defect you discovered was already there at the time of completion.
b) Product warranty
In which cases can you exercise your product warranty rights?
In the event of a defect in the purchased product, you may, at your option, claim warranty claims or product warranty claims.
What are your rights under your product warranty claim?
As a product warranty claim, you may only request the repair or replacement of the defective product.
In which case is the product considered defective?
The product is defective if it does not meet the quality requirements applicable at the time of placing it on the market or if it does not have the properties described by the Evetke Wear webshop operator, as manufacturer.
What is the deadline for enforcing your product warranty claim?
You may enforce your product warranty claim within two years of the product being placed on the market by the Evetke Wear webshop operator. At the end of this period, you will lose the right to do so.
In what cases is Evetke Wear webshop operator as manufacturer and distributor exempt from product warranty?
Evetke Wear webshop operator, as a manufacturer and distributor, is exempted from product warranty only if it can prove that:
the product was not manufactured or marketed in the course of its business, or
the fault was not recognizable at the time of placing on the market, according to the state of the science and technology
a product defect results from the application of legislation or mandatory regulatory requirements.
The Evetke Wear webshop operator, as a manufacturer and distributor, must provide satisfactory reasons to be exempt from product warranty.
Please note that due to the same error, you may not enforce warranty claims and product warranty claims simultaneously. However, in the event of effective enforcement of your product warranty claim, you may enforce the warranty claim for the replaced product or repaired part against the Evetke Wear webshop operator.
